REC'D JAN ? 2003 <br /> <br />1732093 <br /> <br />Councilmember Kurak introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-09-232 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO WILLIAM AND ELIZABETH ERHART TO EXCEED THE HEIGHT <br />RESTRICTIONS FOR A DETACHED ACCESSORY BUILDING ON PROPERTY <br />LOCATED WITHIN THE METROPOLITAN URBAN SERVICE AREA (MUSA) AND <br />DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, William and Elizabeth Erhart (Permittees) have properly applied for a <br />conditional use permit to exceed detached accessory building height restrictions for properties <br />located within the Metropolitan Urban Service Area (MUSA) established in section 9.11.02 <br />"Accessory Uses" of City Code on the property generally known as 4740 154t~ Lane and legally <br />described as follows: <br /> <br />Lot 11, Block 1, Stanhope River Hills, Anoka County, Minnesota <br /> <br /> (Subject Property) . <br /> <br /> WHEREAS, the Planning Commission met on August 2, 2002, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0630, a Conditional Use Permit (Permit) to exceed detached <br />accessory building height restrictions for properties located within the MUSA as established <br />in City Code, is hereby granted to William and Elizabeth Erhart, hereinafter referred to as the <br />"Permittees". <br /> <br />That the detached accessory building may exceed the sixteen (16) foot detached accessory <br />building height restriction for properties located within the Metropolitan Urban Service Area <br />by a total of 6 feet in order to match the design of the principal dwelling on the Subject <br />Property. <br /> <br />3. That the detached accessory building constructed on the property will comply with the <br /> permitted accessory structure square footage restrictions established in City Code. <br /> <br />4. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br /> <br />
