Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION 02-09-233 <br /> <br />A RESOLUTION APPROVING A ONE YEAR EXTENSION TO INITIATE THE <br />CONDITIONAL USE PERMIT ISSUED TO VERIZON WIRELESS FOR THE <br />CONSTRUCTION AND OPERATION OF CELLULAR ANTENNAS ON THE CITY'S <br />WATER TOWER. <br /> <br /> WHEREAS, the Ramsey City Council (the "City") adopted Resolution/tO 1-10-383 adopting <br />Findings of Fact//0579 relating to a request from Verizon Wireless for a conditional use permit to <br />construct and operate cellular antennas on the City of Ramsey's water tower; and <br /> <br /> WHEREAS, on October 9, 2002, the Ramsey City Council approved the request for a <br />conditional use permit and adopted Resolution//01-10-383 declaring terms of same; and <br /> <br /> WHEREAS, the Section 9.03.04 of the Ramsey City Code states that a conditional use <br />permit shall expire if the permit holder fails to initiate such conditional use permit and fulfill each <br />and every condition attached thereto within one (1) year from the date of its authorization,, or if the <br />use is discontinued for a continuous twelve (12) month period, unless a petition for an extension of <br />time in which to complete or utilize the use that has been granted by the Council; and <br /> <br /> WHEREAS, the City of Ramsey received a letter from Jim Nelson, Authorized Agent from <br />Verizon Wireless, dated July 26, 2002 in which, it is stated that due to continual negotiations <br />regarding the lease agreement, the Permit Holder has not been able to initiate the conditional use <br />permit and therein requests an extension of time. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That a one year extension to September 30, 2003, is herein granted to the Permit Holder to <br /> initiate the conditional use permit on the property legally described as follows: <br /> <br />Lot B, Block O/L, AEC Energy Park, Anoka County, Minnesota <br /> <br />Upon written notice being provided by.the City to the Permit Holder but without <br />further action by the Planning Commission or Council, this Permit extension shall <br />expire if the Permit Holder fails to initiate such extended conditional use permit and <br />fulfill each and every condition attached thereto by September 30, 2003, unless a <br />petition for an extension of time in which to complete or utilize the use that has been <br />granted by the City Council Such extension shall be requested in writing and filed <br />with the City at least thirty (30) days before September 30, 2003. <br /> <br /> <br />
