Councilmember Kurak introduced the following resolution: <br /> <br /> RESOLUTION #02-09-251 <br /> <br />41261O <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO MARSHALL CONCRETE TO EXPAND THE LAWFUL NON-CONFORMING <br />READY MIX PLANT TO INCLUDE A SECOND PRODUCT SILO, BASED UPON <br />FINDINGS OF FACT #0631, AND DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, Marshall Concrete Products, Inc. has properly applied for a conditional use <br />permit (CUP) on the property legally described as follows: <br /> <br />Lot 3, Block 1, Park 67 Industrial Park; <br /> <br />The South 175 feet of West 110 feet of Lot 4, Block 1, Park 67 Industrial Park; <br />-and- <br />Outlot B, Business Park 95 5th Addition; all in Anoka County, Minnesota. <br /> <br /> (the "Subject Property") . <br /> <br /> WHEREAS, the Planning Commission met on June 6,~ 2002, conducted a Public hearing <br />and recommended City Council approval of the request to expand the lawful non-conforming <br />ready mix plant on the Subject Property to include a second product silo, contingent upon <br />installation of certain site improvements. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />This CUP shall be perpetual in its duration so long as the conditions imposed herein are <br />complied with. <br /> <br />Approval is herein granted for the Permittee to enlarge the lawful nonconforming <br />concrete ready-mix plan with the addition of a second industrial silo on the Subject <br />Property that shall not exceed 61 feet in height, as measured from the mean ground level. <br /> <br />That the Permittee shall to install a ten (10 foot) high bunker/earth berm parallel to i40th <br />Avenue N.W., east of the site access, for the purpose'of positioning the raw materials: in <br />an orderly fashion on the site and screening the intense industrial activities from public <br />view on 140th Avenue N.W. The bunker/berm wall shall be at least 10 feet tall, as <br />measured from the top of curbline, and the materials used are subject to the approval of <br />the City, with consideration given to the level of maintenance required, durability, <br /> <br /> <br />
