Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-10-253 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0632 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE FRONT YARD SETBACK AND TO CONSTRUCT AN <br />ACCESSORY STRUCTURE CLOSER TO THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, Cindi and Michael Heying, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 of the Ramsey City Code to construct an <br />accessory structure closer to the front property line than the principal structure on the property <br />generally known as 17211 Willemite St. NW and legally described as follows: <br /> <br />Lot 7, Block 1, Golden Eagle Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on October 3, 2002, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned R-1 Single Family, is located outside the 2020 <br /> Metropolitan Urban Service Area, and is approximately 0.95 acres in size. <br /> <br />o <br /> <br />That the Subject Property is bordered to the east by properties zoned R-1 Single Family <br />(Rural Preserve) and to the north, south, and west by properties zoned R-1 Single Family <br />(Rural Developing) zoning. <br /> <br />4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of accessory <br /> structures closer to the front property line than the principal structure. <br /> <br />5. That Section 9.20.11 of the Ramsey City Code states that the front yard setback, for lots <br /> zoned as Rural Developing, is forty (40) feet. <br /> <br />6. That the principal structure on the Subject Property is approximately 40 feet from the <br /> property line. <br /> <br />7. That ihe Applicant is proposing to construct an accessory building that will be approximately <br /> thirty-three (33) feet from the property line. <br /> <br />That there are special conditions applying to the Subject Property that do not generally apply <br />to other properties in the district; namely, the north side yard contains a Northern States <br />Power Company easement spanning seventy-five (75) feet (both north and south) from the <br />center line; the rear yard contains the drain field and location for an alternative septic system; <br />there are mature trees scattered across the property. <br /> <br /> <br />
