O 2.083 <br /> <br />1777903 <br /> <br />Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 02-10-271 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO EXCEED THE ACCESSORY BUILDING SIZE RESTRICTION BASED ON <br />FINDINGS OF FACT #0634 AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Cindi and Michael Heying (Permittee) have properly applied for a <br />conditional use permit to exceed the accessory building size restriction for properties located <br />outside the Metropolitan Urban Service Area (MUSA) established in section 9.11.02 "Accessory <br />Uses" of City Code on the property generally known as 17211 Willemite St NW and legally <br />described as follows: <br /> <br />Lot 7, Block 1, Golden Eagle Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on October 3, 2002, conducted the <br />public heading and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0634, a conditional use permit (Permit) to exceed the accessory <br />building size restriction for properties located outside the MUSA as established in City Code, <br />is hereby granted to Cindi and Michael Heying, hereinafter referred to as the "Permittee". <br /> <br />That the detached accessory building may exceed the 1,488 square foot accessory building <br />size restriction for properties located outside the Metropolitan Urban Service Area by a total <br />of 72 feet in order to accommodate the inside storage of a classic car and other personal-use <br />equipment and vehicles. <br /> <br />3. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />That the accessory building shall be properly conStructed and maintained in accordance with <br />all applicable Uniform Building Codes. <br /> <br />5. The Permittee herein agrees that no business or residential use will be operated in the <br /> detached accessory building unless such use is permitted in accordance with the City Code. <br /> <br />6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br /> <br />
