of said U.S. Trunk Highway No. 10 a distance of 485.00 feet to the actual point of <br />beginning of the tract to be herein described; thence continuing along the northerly <br />right-of-way of said highway a distance of 140 feet; thence northerly to a point on <br />said southerly right-of-way line of said Burlington Northern Railroad distant 691.80 <br />feet southeasterly from the west line of the Northeast Quarter of the Southwest <br />Quarter as measured along the southerly right-of-way of the Burlington Northern <br />Railroad; thence northwesterly along said southerly right-of-way line of said <br />Burlington Northern Railroad a distance of 140 feet; thence southwesterly to the <br />point of beginning. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on December 5, 2002, and that the <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />2) <br /> <br />That the Subject Property is approximately 2.7 acres in size and is zoned B-3 Highway <br />Business; the surrounding parcels are zoned B-3 Highway Business and Business <br />Warehouse. <br /> <br />3) <br /> <br />That Section 9.20.23 (B-3 Highway Business) of the Ramsey City Code states that motor <br />vehicle sales is a permitted use and all vehicle display areas, as well as <br />customer/employee parking areas, must be surfaced with bituminous or concrete and the <br />perimeter of said pavement must be finished with B6/12 concrete curbing. <br /> <br />4) <br /> <br />That Section 9.11.23 (Off-Street Parking Spaces Required) states that one (1) off-street <br />parking space is required for every ten (10) vehicles displayed for sale. <br /> <br />s) <br /> <br />That Section 9.11.09 (Screening) states that all business uses shall provide a landscaped <br />area along all streets that is at least 20 feet in depth. <br /> <br />6) <br /> <br />That on November 8, 2002, the Applicant submitted a request for an Interim Use Permit <br />to establish a motor vehicle sales business on the Subject Property in the absence of the <br />required pavement due to weather conditions not being conducive to installing the <br />requirement improvements. <br /> <br />7) <br /> <br />That the Applicant has submitted a Grading, Drainage & Erosion Control Plan prepared <br />by John Oliver and Associates, Inc., dated October 3, 2002, revision dated November 5, <br />2002, that contains a 2-phase plan to pave the customer/employee and vehicle display <br />areas by December, 2003; with both phases completed by December 31, 2003. <br /> <br />8) <br /> <br />That the Grading, Drainage & Erosion Control Plan prepared by John Oliver and <br />Associates, Inc., dated October 3, 2002, revised November 5, 2002, identifies compliance <br />with the following district performance standards: a) 20 foot wide landscaped area <br />adjacent to the public road (Hwy. #10); b) paved customer, employee and vehicle display <br />area; c) providing off-street parking in excess of City Code requirements (26 <br />customer/employee spaces for 140 display spaces). <br /> <br />9) <br /> <br />That the proposed use will conform to the performance standards of the B-3 Highway <br />Business District upon completion of the site improvements identified in the Grading, <br />Drainage & Erosion Control Plan dated October 3, 2002, revised November 5, 2002. <br /> <br />RESOLUTION #02-12-311 <br /> Page 2 of 4 <br /> <br /> <br />
