Councilmember Hendriksen introduced the following resolution and moved for its adoption: RESOLUTION//02-12-312 A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT TO E-Z AUTO SALES, INC., TO OPERATE A MOTOR VEHICLE SALES LOT ON AN UNIMPROVED SURFACE FOR AN INTERIM PERIOD OF TIME, BASED ON FINDINGS OF FACT #0639; AND DECLARING THE TERMS OF SAME. WHEREAS, Todd Bialon of E-Z Auto Sales, Inc., hereinafter referred to as "Permittee", has properly applied to the City of Ramsey (the "City") for an Interim Use Permit (" Permit") to operate a motor vehicle sales lot on an unimproved surface for an interim period of time on the proposed generally kno .wn as 7751 Hwy. #10 N.W. and legally described as follows: That part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota, described as follows: Beginning at a point of intersection of the west line of said Northeast Quarter of the Southwest Quarter with the southerly right-of-way line of the Burlington Northern Railroad; thence southerly along said west line of said Northeast Quarter of the Southwest Quarter to its intersection with the northerly right-of-way line of U.S. Trunk Highway No. 10; thence southeasterly along said northerly right-of-way line of said U.S. Trunk Highway No. 10 a distance of 300.00 feet; thence northerly to a point on said southerly right-of-way line of said Burlington Northern Railroad, distant 366.80 feet southeasterly from the point of beginning; thence northwesterly along said southerly right-of-way line of said Burlington Northern Railroad to the point of beginning. and That part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota, described as follows: Beginning at the point of intersection of the west line of said Northeast Quarter of the Southwest Quarter with the southerly right-of-way line of the Burlington Northern Railroad; thence southerly along said west line of said Northeast Quarter of the Southwest Quarter to its intersection with the northerly right-of-way line of U.S. Trunk Highway No. 10; thence southeasterly along said northerly right-of-way line of said U.S. Trunk Highway No. 10 a distance of 300.00 feet to the actual point of beginning of the tract to be herein described; thence continuing along the northerly right-of-way line of said highway a distance of 185 feet; thence northerly to a point on said southerly right-of-way of said Burlington Northern Railroad distant 551.80 feet southeasterly from the west line of said Northeast Quarter of the Southwest Quarter, as measured along said southerly right-of-way line of the Burlington Northern Railroad; thence northwesterly along said southerly right-of-way line of the Burlington Northern Railroad a distance of 185 feet; thence southwesterly to the point of beginning. and That part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota, described as follows: Beginning at the point of intersection of the west line of said Northeast Quarter of the Southwest Quarter with the southerly right-of-way line of the Burlington Northern Railroad; thence southerly along said west line of said Northeast Quarter of the Southwest Quarter to its intersection with the northerly right-of-way line of U.S.
