• along the southwesterly line of said Inverness Lane NW; thence southeasterly 321.65 feet along said southwesterly line of Inverness Lane NW on a 686.66 foot radius tangential curve concave southwesterly with a central angle of 26 degrees 50 minutes 19 seconds; thence south 38 degrees 19 minutes 16 seconds east 342.63 feet along said southwesterly line of Inverness Lane NW; thence north 51 degrees 40 minutes 44 seconds east 434.22 feet along the southeasterly line of said Inverness Lane NW to the point of beginning. Said parcel contains 81.1± acres more or less. Subject to easements, reservations and restrictions of record, if any. Or upon recording, St. Andrews Addition, Anoka County, Minnesota (the "Subject Property ") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 1. That on April 28, 1987, a permit was issued to L &G Rehbein, Inc. and North Fork, Inc. for the grading and excavating of a lake in the Northfork P.U.D. 2. That the permit issued in 1987 had no set expiration date and subsequent to its issuance, the City of Ramsey amended its grading and mining regulations. 3. That on April 23, 1991, the City of Ramsey reissued the 1987 permit in accordance with the revised grading and mining regulations. 4. That on August 13, 1991, the City of Ramsey approved transferring the grading and mining permit from L &G Rehbein, Inc. to Glenn Rehbein, Inc. 5. That the permit issued to Glenn Rehbein, Inc. in 1991 contained an expiration date of July 31, 1992. 6. That on October 26, 1995, the City of Ramsey received an application from North Fork, Inc., hereinafter referred to as "Applicant ", for the reissuance of a permit to exports soils associated with the completion of the lake excavation and revised lot grades for the creation of walk -out sites. 7. That the permit issued in 1995 contained an expiration date of February 28, 1999; the material was never exported and the permit has lapsed. 8. That on December 14, 2000, the City of Ramsey received a new application to grade and export soils from the Subject Property. 9. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on January 2, 2001, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 10. That the Subject Property is located in a golf course /residential area of a Planned Unit Development and the proposed area for grading is approximately eighty (80) acres in size.
