• <br />• <br />WHEREAS, all versions of the draft ordinance recognize that compliance with the literal <br />interpretation of the density transition requirements contained in the City Charter may not be <br />reasonable or feasible in all cases; and <br />WHEREAS, all versions of the draft ordinance propose to waive the density transition <br />requirements on parcels that were zoned for densities higher than single family as of October 22, <br />1997; and <br />WHEREAS, all versions of the draft ordinance contain a provision wherein the owners <br />of adjacent lands can waive the density transitioning requirement on the common property line <br />with their respective parcels when they feel it is unnecessary or impractical; and <br />WHEREAS, 'the configuration of the Subject Property is such that literal application of <br />the City Charter density transition requirements is not possible, the Subject Property was zoned <br />for multi - family housing prior to October 22, 1997, and the City has not received any verbal or <br />written comments of opposition to the development proposal from any of the owners of the 10 <br />parcels adjacent to the Subject Property. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council recognizes that the 36% reduction in allowable units per acre <br />in the development proposal for the Subject Property appears to meet the spirit of the City <br />Charter language pertaining to density transitioning and hereby grants preliminary plat and <br />site plan approval to Orchard Hills in accordance with relevant City Codes, contingent upon <br />compliance with the City Staff Review Letters dated December 1, 2000, revision date <br />January 3, 2001. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Anderson <br />Councilmember Kurak <br />Councilmember Zimmerman <br />and the following voted against the same: <br />Councilmember Hendriksen <br />and the following abstained: <br />None <br />RESOLUTION #01 - - 138 <br />Page 3 of 4 <br />
