5. That the fee title owner of the land to be leased to the Permittees herein agrees that the <br />calculation for number of horses allowed on his/her property is decreased by four (4) acres. <br />6. The Permittee agrees to handle the manure production in accordance with section 5.09.05 <br />(Horses) of Ramsey City Code which states that manure shall be removed with sufficient <br />frequency to avoid nuisance from odors or from the breeding of flies at least once every two <br />weeks. Manure shall be removed by hauling beyond the City limits unless used for <br />fertilizer, in which case it shall be spread upon the ground evenly and turned under at once <br />or as soon as the frost leaves the ground. <br />7. Upon confirmation of complaints regarding the nuisance of horses the City may take action <br />to abate the nuisance in accordance with Section 5.09.01. <br />8. That upon any conviction of an animal nuisance pursuant to Item #7 herein, the City may <br />also take action to revoke this Permit pursuant to its conditional use permit revocation <br />procedures. <br />9. This Permit is subject to all of the rules and conditions of other relevant City Code <br />provisions and in particular, it is subject to all the terms and conditions of Section 5.09.05 <br />(Horses). <br />10. In the event that the property becomes void of horses for a period of six contiguous months, <br />the conditional use permit will become null and void. <br />11. That the City Administrator, or his/her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br />12. That the Permittee shall be responsible for City costs incurred in administering and <br />enforcing this conditional use permit. <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br />Kurak, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Hendriksen <br />Councilmember Kurak <br />Councilmember Anderson <br />Councilmember Zimmerman <br />and the following voted against the same: <br />None <br />RESOLUTION #01- 02446 <br />Page 2 of 4 <br />
