• <br />28 seconds a distance of 467.89 feet; thence South 11 degrees 47 minutes 32 seconds <br />East, tangent to last said curve a distance of 164.54 feet; thence southerly and <br />westerly along a tangential curve concave to the west having a radius of 295.27 feet, <br />a central angle of 101 degrees 11 minutes 13 seconds, a distance of 521.46 feet; <br />thence South 89 degrees 23 minutes 42 seconds West, tangent to last said curve a <br />distance of 210.53 feet and said centerline there terminating. <br />(" Subject Property" ); and <br />WHEREAS, the Applicant is proposing to develop a multi - family housing project <br />(twinhomes, quad - townhomes, and a four -plex) on an 11.3 acre site which includes the Subject <br />Property; and <br />WHEREAS, nine acres of the 11.3 acre project site is zoned R -3 Urban Residential; the <br />remaining 2.3 acres is zoned R -1 Urban Residential and requires a rezoning to R -3 Urban <br />Residential to accommodate the proposed development project; and <br />WHEREAS, the City has received testimony from some surrounding property owners <br />that they believe that their property value will be diminished due to this rezoning; and <br />WHEREAS, the rezoning of the R -1 Urban Residential portion of development area to <br />R -3 Urban Residential is critical to the proposed subdivision and site plan submitted to the City <br />110 for approval; and <br />WHEREAS, on November 28, 2000, the City Council adopted Findings of Fact #0541 <br />regarding the proposed rezoning; and <br />WHEREAS, on February 27, 2001, the City Council adopted a resolution to deny the <br />proposed rezoning. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That the City Council herein denies final plat approval of the proposed subdivision, <br />Sunwood Estates, based on the absence of appropriate zoning to accommodate the <br />development plan that has been proposed to the City. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Hendriksen <br />Councilmember Zimmerman <br />Councilmember Anderson <br />Councilmember Kurak <br />RESOLUTION #01 -02 -148 <br />Page 2 of 3 <br />
