Under the <br />ordinance, any dispensary must be approved by the Newark Board of Zon- <br />ing Appeals. The ordinance also limits the location of dispensaries by <br />restricting them to "medium intensity business districts" and from within <br />1,000 feet of a school, church, public library, public playground or public <br />park. A variance from the Board of Zoning Appeals could reduce that <br />distance to 750 feet away from the restricted areas. The location of medi- <br />cal marijuana cultivators and processors would be limited to industrial <br />districts. The businesses are also required to obtain a license from the City <br />and pay an annual $500 fee. <br />S ource: Newark Advocate; www.newarkadvocate.com <br />WISCONSIN <br />In late November, Governor Scott Walker signed into law the "Home- <br />owners' Bill of Rights." The new legislation, consists of two bills: One bill <br />"allows property owners to build on and sell lots of `substandard' size if <br />they were legal when created." That bill also "prohibits local governments <br />from merging adjacent lots that share the same owner without the owner's <br />permission and makes it easier for property owners to get conditional -use <br />permits and variances, maintain nonconforming structures, and dredge <br />private ponds."
