recommends approval of the request for an Interim Use Permit. The Permit is drafted to allow <br />Mr. Bialon use of the west half of the site (Phase 1) without benefit of the required pavement and <br />curbing until June 30, 2003. A financial surety will be required to ensure timely installation of <br />the improvements. Absolutely no use of the east half of the site (Phase 2) may occur until that <br />area has been improved in accordance with the approved grading and drainage plan. City Staff <br />also recommends waiving the 10-day interval rule between Planning Commission and City <br />Council action. If Council is not inclined to waive the 10 day rule, then City Staff will notify <br />Mr. Bialon that an extension will be imposed and the request will be on the January 14, 2003 <br />Council agenda for action. <br /> <br />Councilmember Anderson stated that she knows of an area in Ramsey where they installed <br />asphalt on a property last week. She inquired if there was any chance of getting the asphalt in <br />this week since it is going to be so warm. <br /> <br />Todd Bialon, E-Z Auto Sales, Inc., replied that he has not purchased the property as of yet. He is <br />waiting for approval from the City before closing on the property. <br /> <br />City Engineer Olson noted that the area that was paved last week is only temporary and will be <br />removed next spring. <br /> <br />Councilmember Kurak stated that she would be abstaining from the discussions and voting on <br />the issue. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Zimmerman, to waive the 10-day <br />interval rule between Planning Commission and City Council action on the request from E-Z <br />Auto for an Interim Use Permit. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Anderson, and <br />Hendriksen. Voting No: None. Abstain: CouncilmemberKurak. <br /> <br />Councilmember Hendriksen stated that $23,875 seems to be to low for being 125 percent of the <br />cost of site improvements. <br /> <br />Community Development Director Frolik explained that that amount is for the west half of the <br />property. She explained that phase I is what is being required to be paved by June 2003. If the <br />business were to expand in the future they would have to pave the second phase. <br /> <br />Councilmember Hendriksen inquired if there was strong language that they could include in the <br />conditional use permit indicating that the unpaved area ~cannot be used to store vehicles. <br /> <br />Community Development Director Frolik noted that condition #4 states "That absolutely no use <br />of that area identified as Phase 2 on the Plan can occur until the required pavement and curbing <br />has been installed in accordance with the Plan." <br /> <br />City CounCil/December 10, 2002 <br /> Page 8 of 13 <br /> <br /> <br />
