Councilmember Kurak stated that she understands that there are open space requirements for
these types of developments and that open space is being proposed as part of the plat, but she is
uncomfortable with the amount of unitsbeing proposed. She inquired if other Councilmembers
agreed.

Associate Planner Wald noted that City Code requires 40 percent open space and the developer is
proposing 64 percent of open space.

Councilmember Kurak replied that City Code currently allows, for ponds and wetlands to be
considered open space, which she does not agree with. In her opinion she thought the proposed
development was too compact.

Mayor Gamec stated that this development would provide for more open space than other
developments approved in the City.

Councilmember Hendriksen stated his position is that the City has enacted a comprehensive plan
that allows for too much density.

Councilmember Kurak stated that the Council should address the issue of how they determine
open space in the City Code as soon as possible.

Councilmember Hendriksen stated that the Council does not have to approve the configuration
and if they feel there should be more open space then they should vote against it.

Councilmember Kurak inquired if the developer was willing to provide for more open space by
eliminating one of the end units.

Dave Schulte, Turtle Moon, Inc., stated that they have worked hard to comply with all of the
City's requirements. He also noted that as part of Rivenwick 1st and 2ha' they donated a
significant amount of parkland, which he reviewed.

Councilmember Kurak inquired if there will be a trail from the proposed development to the
existing parkland.

Mr. Schulte replied that that is what the Park Commission hasJrequested.

Councilmember Kurak inquired as to how the developer was proposing to address existing
intrusion issues from adjoining neighbors along the existing berm.

Mr. Schulte replied that there is an issue of a fence on one of the properties and they are willing
to work with those people by granting them an easement as to not cloud the title.

Councilmember Kurak stated that she would like that language to be included in the
development agreement.

City Council/November 12, 2002
