Councilmember Kurak stated that she understands that there are open space requirements for <br />these types of developments and that open space is being proposed as part of the plat, but she is <br />uncomfortable with the amount of unitsbeing proposed. She inquired if other Councilmembers <br />agreed. <br /> <br />Associate Planner Wald noted that City Code requires 40 percent open space and the developer is <br />proposing 64 percent of open space. <br /> <br />Councilmember Kurak replied that City Code currently allows, for ponds and wetlands to be <br />considered open space, which she does not agree with. In her opinion she thought the proposed <br />development was too compact. <br /> <br />Mayor Gamec stated that this development would provide for more open space than other <br />developments approved in the City. <br /> <br />Councilmember Hendriksen stated his position is that the City has enacted a comprehensive plan <br />that allows for too much density. <br /> <br />Councilmember Kurak stated that the Council should address the issue of how they determine <br />open space in the City Code as soon as possible. <br /> <br />Councilmember Hendriksen stated that the Council does not have to approve the configuration <br />and if they feel there should be more open space then they should vote against it. <br /> <br />Councilmember Kurak inquired if the developer was willing to provide for more open space by <br />eliminating one of the end units. <br /> <br />Dave Schulte, Turtle Moon, Inc., stated that they have worked hard to comply with all of the <br />City's requirements. He also noted that as part of Rivenwick 1st and 2ha' they donated a <br />significant amount of parkland, which he reviewed. <br /> <br />Councilmember Kurak inquired if there will be a trail from the proposed development to the <br />existing parkland. <br /> <br />Mr. Schulte replied that that is what the Park Commission hasJrequested. <br /> <br />Councilmember Kurak inquired as to how the developer was proposing to address existing <br />intrusion issues from adjoining neighbors along the existing berm. <br /> <br />Mr. Schulte replied that there is an issue of a fence on one of the properties and they are willing <br />to work with those people by granting them an easement as to not cloud the title. <br /> <br />Councilmember Kurak stated that she would like that language to be included in the <br />development agreement. <br /> <br />City Council/November 12, 2002 <br /> Page 14 of 22 <br /> <br /> <br />
