Principal City Engineer Olson noted that there .is an area where they are proposing a driveway <br />directly across 157tw'' which will require them to cross a small portion of wetland. The developer <br />does have a WMO permit for the process, but they will also have to get an exemption from the <br />WMO who has the rights to the wetland. The WMO feels that the exemption should be granted <br />since there is a 400 foot exemption and the plans indicate a 320 foot impact. <br /> <br />Councilmember Hendriksen stated that he had previously thought that they were going to access <br />the site via the old field road in which case they would have been way in excess of 400 feet. <br /> <br />Principal City Engineer Olson agreed. <br /> <br />Councilmember Zimmerman inquired if the septic system on Lot 1 will be on natural groUnd. <br /> <br />Principal City Engineer Olson replied yes. <br /> <br />Councilmember Kurak stated that when the City dealt with the subdivision on the McDonald <br />Property the City required that the applicant indicate where future subdivisions could go. She <br />inquired as to why that was not being done in this case. <br /> <br />Principal Planner Trudgeon replied that that will occur as part of final plat. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#02-10-273 approving the preliminary plat of White Oak Addition, contingent on compliance <br />with City staff review letter dated August 29, 2002, revised September 17, 2002, revised October <br />4, 2002, revised October 18, 2002, and Anoka County Highway Department review letter dated <br />October 9, 2002. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, <br />Hendriksen, and Zimmerman. Voting No: None. <br /> <br />and Councilmembers Kurak, <br /> <br />Anderson, <br /> <br />Case #8: <br /> <br />Request for Final Plat ApprOval of Mallard Ponds 2na Addition Minor <br />Subdivision: Case of Bulow, Inc. <br /> <br />Principal Planner Trudgeon stated that Bulow Inc. is requesting a minor subdivision to replat an <br />existing lot and outlot into one lot, Chris Bulow would like to develop a 6,000 square foot multi- <br />tenant commercial building on the new lot. The minor subdivision would combine Lot 97, Block <br />1 and Outlot A of the Mallard Ponds subdivision. The minor subdivision consists of two lots <br />(Lot 97, Block 1 and Outlot A, Mallard Ponds) being combined into one lot. The new lot is <br />proposed to be 0.94 acres in size. Lot 97, Block 1 is a vacant lot and was designated for a <br />commercial lot as part of the Mallard Ponds P.U.D., and the Flintwood Hills 2nd Addition P.U.D. <br />prior to Mallard Ponds. Oultot A is owned by Bulow Inc. and is a ten-foot wide lot around the <br />perimeter of the Mallard Ponds subdivision.
