three larger, rural lots on the west that are also zoned R-1 Residential, located within the MUSA
and eligible for redevelopment at urban standards. The new density transition ordinance does not
clearly state what the requirements would be, if any, in situations where the adjacent property is
in the MUSA, zoned the same as the developing parcel, but currently consists of the larger, rural
type lots.

John Peterson, Oakwood Land Development, stated that he has been working with the existing
four homeowners on the site and has entered into a purchase agreement with each of them. In
addition, he has met with all of the property owners to the west of the proposed development.
The first property is a rental property, the second parcel is five acres with a pretty significant
boundary, and the third property owner has lived on the property for many years. Each of the
homeowners has seen the plan and they all understand the potential of their own property being
developed in the future. He did not want to speak for those homeowners, but he did feel they
understood the development potential. He noted that the only issue with the larger parcel is that
it was used to raise elk and so it contains a ten-foot tall fence along a substantial distance of the
property. One resident has asked that they extend that fence and he has told them that they
could. Mr. Peterson stated that the natural screening that exists on the property turns out to be
perfect. He presented pictures of the property and inventory of how many trees would serve as a
screen on each of the lots. He also stated that he would be willing to place restrictive covenants
on the property so that none of the buffering trees could be disturbed.

Councilmember Kurak inquired as to how many of the trees pictured were on his property.

Mr. Peterson replied that all of the trees he included in the inventory presented to the Council are
on his land. He noted that there are additional trees on the adjacent parcels.

Councilmember Hendriksen inquired if the residents were aware of the meeting since part of
their decision should be based on hearing from the residents.

Mr. Peterson replied that he was not asking for a decision from the Council at tonight's meeting.
He was only looking for an informal discussion. He noted that all of the residents are aware that
there will be a public hearing.

Councilmember Hendriksen inquired if staff notified any of the residents of this meeting.

Community Development Director Frolik replied no, because there will be a public hearing.

Mr. Peterson stated that each of the property owners understand that bringing sewer and water to
their property will increase the value of their properties, but he does not want to put any words in
their mouths. He would like them to have the opportunity to speak at the public hearing.

Councilmember Hendriksen stated that he thinks residents should be heard on what they want
and be able to make an informed decision. The only part that concerns him is that if they are
only deriving the information from the developer they might only have one side of the story.

City Council/October 15, 2002
