8. That,if granted,the variance will not unreasonably diminish or impair established property <br /> values within the neighborhood. <br /> 9. That, if granted, the variance will not violate the intent and purpose of the Comprehensive <br /> Plan. <br /> NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br /> CITY OF RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> That the Ramsey Planning Commission hereby grants a variance (the "Variance") to allow the <br /> utilization of a septic system and private well on the Subject Property with the following <br /> conditions: <br /> 1. That this Variance shall be perpetual in its duration so long as the conditions imposed herein <br /> are complied with. <br /> 2. That the Permittee may utilize a private well and an individual subsurface sewage treatment <br /> system (SSTS) on the Subject Property and the construction of both shall be in compliance <br /> with all applicable local and state regulations. <br /> 3. That the Permittee shall be responsible for all costs incurred in administering and enforcing <br /> this variance. <br /> 4. That the Permittee shall obtain all necessary permits prior to commencing any earthwork on <br /> the Subject Property. <br /> 5. That the Permittee shall complete the subdivision process, including recording of the Plat, <br /> Development Agreement, Cross-Access Easement and Trail Easement, prior to commencing <br /> any earthwork. <br /> 6. That this Variance shall automatically expire if the use is not initiated by May 3, 2019, and <br /> issuance of the Building Permit to construct a single family home shall constitute initiation. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br /> Surma, and upon vote being taken thereon, the following voted in favor thereof: <br /> Chairperson Bauer <br /> Commissioner Gengler <br /> Commissioner Surma <br /> Commissioner Anderson <br /> Commissioner Onyambu <br /> Commissioner Van Scoy <br /> and the following voted against the same: <br /> None <br /> RESOLUTION#18-089 <br /> Page 3 of 6 <br />
