Councilmember Cook introduced the following resolution and moved for its adoption: <br /> RESOLUTION//04-10-330 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT //0706 RELATING TO A <br />REQUEST TO ALLOW FOR THE OPERATION OF A CHURCH IN THE E-1 <br />EMPLOYMENT DISTRICT <br /> <br /> WHEREAS, the St. Katharine Drexel Catholic Community, hereinafter referred to as <br />"Applicant", has properly applied to the City of Ramsey (the "City") for an interim use permit to <br />operate a Church in the E-1 Employment District on the property located at 6390 McKinley St. <br />legally described as follows: <br /> <br />Lot 1, Block 2, Business Park 95 4th Addition, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on October 7, 2004, and that the public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />That the Subject Property is zoned E-1 Employment; the adjacent parcels to the north and <br />east are zoned E-1 Employment, the property to west is E~2 Employment and the property is <br />bounded on the south by the Burlington Northern Santa Fe Railroad and property zoned H-1 <br />Highway 10 Business District. <br /> <br />3. That the E-1 Employment District does not allow for churches as a permitted use. <br /> <br />4. That the Applicant is proposing to utilize i3,440 square feet of the building located at 6390 <br /> McKinley St. for the purpose of a temporary Church facility. <br /> <br />5. That the Applicant is requesting that the Interim Use Permit be granted for at least three <br /> years. <br /> <br />6. That Section 9.03.04A of City Code allows for an Interim Use Permit to be granted for a <br /> maximum of five years. <br /> <br />7. That the proposed use will not adversely impact traffic in the area. <br /> <br />8. That the proposed use will not be dangerous or detrimental to persons residing or working in <br /> the vicinity of the use or to the public welfare. <br /> <br />9. That the proposed use will not substantially or adversely impair the use, enjoyment or market <br /> value of surrounding properties. <br /> <br />10. That the proposed use will be operated and maintained so as to be harmonious and <br /> appropriate in appearance with the existing or intended character of the general vicinity and <br /> such use will not change the essential character of the area. <br /> <br /> <br />
