Councihnember Cook introduced the folloWing resolution and moved for its adoption: <br /> <br />RESOLUTION #04-11-355 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0709 RELATING TO A <br />REQUEST FOR AN AMENDMENT TO CONDITIONAL USE PERMIT TO <br />CONSTRUCT A BUILDING LARGER THAN 35,000 SQURE FEET IN THE <br />TC-2 ZONING DISTRICT <br /> <br /> WHEREAS, Ramdance, LLC, hereinafter referred to as the "Applicant," has properly <br />applied for an amendment to Conditional Use Permit (CLIP) to construct a building larger than <br />35,000 square feet in the TC-2 Zoning District on property legally described as follows: <br /> <br />Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That the Ramsey City Council adopted the Town Center Zoning District on September 23, <br /> 2003. <br /> <br />2. That the Subject Property is zoned TC-2 and is located inside the metropolitan urban service <br /> area. (MUSA). <br /> <br />3. That the TC-2 Zoning District states that buildings larger than 35,000 square feet are only <br /> permitted as a conditional use within the District. <br /> <br />That in June, 2004, the APplicant submitted an application for a Conditional Use Permit to <br />construct a 54,000 square-foot grocery store within the Ramsey Town Center development; <br />with plans for future expansions up to 63,000 square feet. <br /> <br />5. That on July 27, 2004, the Ramsey City Council issued a CLIP to the Applicant for the <br /> development of up to a 63,000 square foot grocery store on the Subject Property. <br /> <br />That in August, 2004, the Applicant submitted a final site plan for the development of the <br />Subject Property that indicated the initial size of the grocery store would be 62,000 square <br />feet versus the former proposal of 54,000 square feet. <br /> <br />7. That the 8,000 square foot increase to the size of the grocery building is in conformance with <br /> the CUP issued by the City on July 27, 2004. <br /> <br /> <br />
