Community Development DirectOr Fr61ik:rePlied the TC-2 District,was written for more auto- <br />oriented business and big box us~s, which would be expected with dri've-thrus. She explained <br />drive-thrus were omitted from the TC''2 zoning so they could be reviewed on a case-by-case <br />basis. ~ <br /> <br />Councilmember KUrak stated the drive~-thrus concern her. <br /> <br />Keith McDonald of Shingobee Builders: stated the drive-thru was added after looking at some <br />of the criteria and wants from the Ci~ty. A coffee shop was greatly desired, and all of the <br />national coffee shops want a drive'thru.: This is really the only place left with any ability for a <br />drive-thru. He explained a fast foOd restaurant could' not be located here, as it is not allowed in <br />this zoning. <br /> <br />Councilmember ElVig concurred with C°uneilmember Kurak. He noted when the task fOrce <br />set up a lot of this criteria they loOked at'thedifferent structures and uses and it was determined <br />that some businesses would :not move' here unless they have a drive-thru. That is why. they <br />came up with the conditional USe permit. ' - <br /> <br />Mr. McDonald stressed that Caribou COffee has expressed an intereSt in the site, but has not <br />signed on yet. The intention is for a coffee ShoP. <br /> <br />Councilmember Cook stated he agrees that this was set up so they did not get inundated with <br />drive-thrus, but he agrees this is a big block area and this is controlled on an individual basis so <br />they can look at each situation. He does not have a problem with this situation, other than <br />hopefully they can work out a decent'traffic flow if the size of the grocery store is increased. <br /> <br />Community Development FrOlik asked,,for input from legal counSel on whether the conditional <br />use permit can be made specific to the user, with resubmittal required if there is a transfer in <br />tenants. <br /> <br />City Attorney Goodrich replied the eon,diti°nal use permit runs with the land. If the conditions <br />are met the condi'tional use permit can be transferred. <br /> <br />Councilmember Elvig inquired if the_permit Can state the hourly volume of traffic. <br /> <br />Jeff schrock of Shingobee Builders indicated according to a traffic study dOne in 1995, a <br />minimum of seven queuing stalls would be required for a fast food restaurant, while Caribou <br />Coffee would be required to have four queuing stalls. <br /> <br />The Council discussed limiting the' queuing to four stalls. <br /> <br />City Attorney Goodrich advised a f'mding would be required as to why the queuing needs to be <br />limited to four stalls. <br /> <br />Councilmember Kurak stated' her concern is the traffic. <br /> <br /> City coUncil/December 14, 2004 <br /> page 23 of 33 <br /> <br />P45 <br /> <br /> <br />
