10. <br /> <br />11. <br /> <br />12. <br /> <br />t3. <br /> <br />t4. <br /> <br />15, <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />That the Subject Property consists of two parcels, Lot 33 Bowers Mississippi Acres and Lot 1 <br />Block I Bowers Mississippi Acres 2"0 Addition. <br /> <br />That Lot 33 Bowers Mississippi Acres was platted in 1948 and Lot 1 Block 1 Bowers <br />Mississippi Acres 2nd Addition was platted in 1964; both have lot widths of 100 feet, are .95 <br />and .97 acres in size respectfully, and are both owned by Donald and Molly Anderson (the <br />Applicant is their son and is acting on their behalf). <br /> <br />That according to Anoka County, Lot 33 Bowers Mississippi Acres and Lot 1 Block 1 <br />Bowers Mississippi Acres 2~d Addition are under one Parcel Identification Number (PIN) for <br />taxing purposes. In order for Lot 1 Block 1 Bowers Mississippi Acres 2nd Addition to be <br />eligible for a building permit, the Applicant must request reassignment of two (2) Parcel <br />Identification Numbers for the two lots. <br /> <br />That there is an existing principal structure located on Lot 33 Bowers Mississippi Acres. <br /> <br />That Lot 1 Block 1 Bowers Mississippi Acres 2"d Addition is a vacant parcel. <br /> <br />That the Applicant must obtain a variance to the lot width and lot area requirements for Lot 1 <br />Block 1 Bowers Mississippi Acres 2nd Addition to render it buildable. <br /> <br />That City records indicate that there are currently five (5) cases of duo-ownership lots <br />(riparian and non-riparian) along Bowers Drive that do not meet the area and width <br />requirements of Section 9.21.07. <br /> <br />That if granted, the variance will not allow any use which is neither a permitted nor a <br />conditional use in the land use district in which the Subject Property is located. <br /> <br />That similar variances have been granted in the Critical River Overlay District. <br /> <br />That there are exceptional circumstances unique to the Subject Property which were not <br />created by the Applicant: a) Lot 1 Block 1 Bowers Mississippi Acres 2"d Addition was a <br />saleable, buildable lot when the lot was created in 1964; and b) the amendmem to the <br />critical river rules in 1985 regarding duo-ownership rendered Lot 1 Block 1 Bowers <br />Mississippi Acres 2"d Addition non-buildable; while four (4) other similarly sized lots not in <br />duo-ownership have been developed since that time; <br /> <br />That the strict enforcement of Section 9.21.07 of the Ramsey City Code will result in <br />unnecessmy hardship to the Applicant. <br /> <br />That if granted, the variance is/is not contrary to the purpose and intent of Section 9.21.07 of <br />the Ramsey City Code. <br /> <br />19.
