Chairperson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-02- <br /> <br />A RESOLUTION DECLARING TERMs OF A VARIANCE TO THE MINIMUM LOT <br />WIDTH AND LOT AREA IN THE CRITICAL RIVER OVERLAY DISTRICT. <br /> <br /> WHEREAS, on FebrumT 3, 2005, the Ramsey Board of Adjustment issued a variance <br />fi'om Section 9.21.07 of the Ramsey City Code which allows for substandard lot size and width <br />on the property legally described as follows: <br /> <br />Lot t Block 1 Bowers Mississippi Acres 2''d Addition TOG/W Lot 33 Bowers Mississippi <br />Acres, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact # , a variance to lot width and lot area is hereby granted in to <br /> render Lot 1 Block 1 Bowers Mississippi Acres 2nd Addition a buildable lot. <br /> <br />2. That Lot 1 Block l Bowers Mississippi Acres 2'~d Addition and Lot 33 Bowers Mississippi <br /> Acres will be .97 and .95 in size respectively, and each will be 100 feet in width. <br /> <br />That Lot 1 Block 1 Bowers Mississippi Acres 2nd Addition will not be eligible for a building <br />permit until such time as Anoka County has assigned a separate Parcel Identification Number <br /> <br />That the Applicant, or future owner, is subject to the Building Permit process and must <br />comply with all International Building Code requirements at such time that a new dwelling is <br />constructed. <br /> <br />That at such time when construction of a new dwelling occurs, the Applicant, or future <br />owner, shall adhere to the Department of Natural Resource's suggested actions as outlined in <br />the letter dated January 21,2005 to help mitigate the impacts of construction. <br /> <br />6. That the Applicant, or future owner, is subject to applicable regulations in the Critical River <br /> Overlay District and the underlying zoning regulations. <br /> <br />7. That the Applicant shall be responsible for all City costs incurred in administering and <br /> enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
