12. Trail Development And Fees..The DEVELOPER agrees to convey to the CITY by a <br /> separate recordable :document a 20 foot wide permanent trail easement over the westernmost <br /> 20 feet of Outlots A, B, C and E of Rivers Bend Third Addition, together with a temporary <br /> slope easement during trail cOnstmction over the eastern 15 feet of the western 35 feet of the <br /> above Outlots. The City CoUncil has enacted a trail development fee in the amount of One <br /> Thousand Ninety Dollars and no' cents ($1,090.00) per acre. Therefore, a payment in the <br /> amount of One ThoUsand Five Hundred Eighty Dollars and no cents ($1,580.00) (1.45 acres <br /> x $1,090/acre) shall be paid to the CITY prior to releasing the Plat for recording. The CITY <br /> will reimburse the DEVELOPER $12/00 per foot for the cost of constructing the trail on <br /> Outlots A, B, and C. <br /> <br />13. Tree, Shrub and Sod Planting plan.: The addition of trees, shrubs and sod to the Plat shall <br /> be in accordance with the approved Site Plan for CNP Storage, prepared by James R. Hill, <br /> Inc., and the Development permit for this Site Plan. The plat is also subject to the Tree <br /> Preservation Plan prepared by James :R. Hill, Inc. The trees to be protected during <br /> construction must be identified onthe grading plan, and the plan must require the installation <br /> of 'tree save fences' Prior to land clearing or grading. <br /> <br />14. Tree Disease Prevention and DiSPosaI. The DEVELOPER shall prevent the introduction <br /> and spread of tree !disease into the residual tree populations of the Plat and adjoining <br /> properties as well as mitigate~ the effects of construction activity on tree health, within and <br /> outside of the Plat. The DEVELOPER, in order to protect trees from construction damage <br /> shall: <br /> <br />a) Install physical barriers, such as snow fence, around trees that are to remain after <br /> initial grading. The fencing shall be located at the dripline of these 'save' trees. <br /> <br />b) Insure that all equipment oPeratOrs will have readily available, a tree wound dressing <br /> and will appty it immediately to idamaged oak trees if wounding occurs from April 15 <br /> through July 15. <br /> <br />c) Insure that trees will only be skidded against other trees that are to be removed. <br /> Trees in the middle twenty (20). feet of a road easement will be removed first, with <br /> remaining trees to be skidded toward the middle of the road easement. This same <br /> procedure will apply t° building sites.: <br /> <br />d) <br /> <br />Mature trees,I especially oak and elm, adjoining an easement so that roots enter the <br />disturbed construction :area shall first be severed by a vibratory plow to prevent <br />shattering, scraping and exposure of roots of high value trees on adjoining property. <br />All exposed root zones of adjoining properties shall be immediately covered with <br />clean topsoil and moistened to favorable conditions. <br /> <br />Ramsey Office Park <br />Development Agreement <br />Page 4 of 8 <br /> <br /> <br />
