CASE #
Consider Adoption of Joint Powers Agreement with Anoka County for Regional
RoadWay ImProvements aSsoCiated with Ramsey Town Center
By: Brian E. Olson, Assistant DPW / Principal City Engineer

Background:

On January 4, 2005, the City CoUncil considered the joint powers agreement with the
Anoka County Highway DePartment and paSsed it with three contingencies.

· Removal of 2 sections allowing termination of the contract.
· Explanation of the Park property language.
· Revision of the disbursement of funds language.

The termination language h~ been and will always be part of this agreement according to
the Anoka County HighwaY Department. This language is included in all of their
agreements and allows them to terminate at their discretion.

It is Staff's opinion that the change Of use in the property that is we are using for the
storm sewer overflow will not ipreclude them from utilizing it as replacement park
property.

Anoka County is working on the disbUrsement of funds language and expects that it will
be done before TueSday night,

Recommended Action:

Staff feels that Anoka CountY has indicated with this Joint Powers Agreement that they
are willing to participate to 'the maximum extent that they are able and recommends a
motion to authorizing the signing of the Joint Powers Agreement with Anoka County.

Reviewed by:

City Administrator
Director of Public Works / Fire Chief
Finance Officer

CC: 02/08/05
