I Planning l Environmental <br />DATE: January 9, 2018 <br />SUBJECT: Response to Official Comments - Draft Scoping EAW for a Proposed AUAR <br />The Draft Scoping Environmental Assessment Worksheet (Scoping EAW) Document for a Proposed AUAR for the North <br />Dayton Development was distributed for public comments on Monday, November 13th, 2017, and multiple comments <br />were received by the 30-Day Public Comment Period deadline of Wednesday, December 13th, 2017. This memorandum <br />documents all of the comments received along with the various ways each comment will be addressed by the AUAR. <br />MINNESOTA DEPARTMENT OF THE ARMY CORPS OF ENGINEERS COMMENTS <br />1) The purpose of this letter is to inform you that based on available information a Department of the Army (DA) <br />permit will likely be required for your proposed activity. <br />Response: All applicable permitting requirements will be included in the AUAR. To this end, wetlands within <br />the development site will be delineated, and determinations will be made as to which agency (or agencies) have <br />jurisdiction. A DA permit may be required for potential wetland impacts <br />2) If the proposal involves activity in navigable waters of the United States, it may be subject to the Corps of <br />Engineers' jurisdiction under Section 10 of the Rivers and Harbors Act of 1899 (Section 10). Section 10 prohibits <br />the construction, excavation, or deposition of materials in, over, or under navigable waters of the United States, <br />or any work that would affect the course, location, condition, or capacity of those waters, unless the work has <br />been authorized by a Department of the Army permit. <br />Response: All applicable permitting requirements will be included in the AUAR. Navigable waters will be <br />identified to determine If Section 10 applies.
