4.5 AVIATION <br />This section identifies policies and <br />ordinances that protect regional airspace <br />from obstructions. <br />According to Federal Aviation <br />Administration (FAA) and MnDOT <br />Aeronautics safety standards, any <br />applicant who proposes to construct a <br />structure 200 feet above the ground level <br />must get appropriate approval. The FAA <br />requires the FAA Form 7460-1 "Notice of <br />Proposed Construction or Alteration", <br />under code of federal regulations <br />CFR-Part 77, be filed for any proposed <br />structure or alteration that exceeds 200 <br />feet. FAA Form 7460-1 can be obtained <br />from FAA headquarters and regional <br />offices. <br />Aerial of the Anoka County -Blaine Aiport <br />'Source: Metropolitan Airports Commission) <br />These forms must be submitted 30 days before alteration/construction begins or the <br />construction permit is filed, whichever is earlier. MnDOT must also be notified (see MnDOT <br />Rules Chapter 8800). The Anoka County -Blaine airport/community zoning board's land use <br />safety zoning ordinance should also be considered when reviewing construction in the <br />county that raises potential aviation conflicts. As required, Anoka County will notify the <br />FAA of any proposed structures. <br />Several lakes are designated in Minnesota State Rules Chapter 8800.2800 as authorized <br />for purposes of safe seaplane use.
