of the sale of property and the Planning Commission previously recommended approval of the <br /> site plan. He noted that the item was removed from the Consent Agenda because of changes <br /> made to the Right of Re-Entry Agreement and provided additional details. He stated that the <br /> document was reviewed with the City Attorney and he is comfortable with the agreement with <br /> the penalty thresholds. He stated that staff has a high level of confidence that the project will <br /> begin construction before the end of the month. <br /> Councilmember Kuzma stated that personally he believes this will move forward. He asked the <br /> timeline for the penalties. <br /> Community Development Director Gladhill stated that if a building permit is not pulled within <br /> six months, the penalty would be $25,000 payable to the City and if construction is not <br /> completed by the end of 2019, there would be a penalty of$50,000. <br /> Councilmember Riley commented that the City does not sell the land ever wanting to get it back <br /> and the right of re-entry simply protects the City to ensure that the land is developed. He noted <br /> that this would still give the City the option to get the land back in the case that needed to <br /> happen. He stated that the right of re-entry agreement was not included in the case. <br /> Community Development Director Gladhill confirmed that although it was not included in the <br /> case, it had been included in past cases. He confirmed that the agreement has been approved to <br /> form and therefore the revised agreement could be accepted tonight. <br /> Motion by Councilmember Riley, seconded by Councilmember Kuzma, to Adopt Resolution <br /> #18-142 Approving Revised Agreements Related to Affinity at Ramsey, Amending the Previous <br /> Approval for the Right of Re-Entry to Include the Two Additional Terms. <br /> Motion carried. Voting Yes: Acting Mayor LeTourneau, Councilmembers Riley, Kuzma, <br /> Johns, and Shryock. Voting No: None. <br /> 8. MAYOR, COUNCIL AND STAFF INPUT <br /> City Administrator Ulrich announced upcoming meetings and events. <br /> Acting Mayor LeTourneau asked for input on the summer events series. <br /> Parks and Assistant Public Works Superintendent Riverblood stated that concert attendance <br /> continues to increase. He stated that the City of Ramsey Foundation helps to fund the concerts <br /> through donations by local businesses. He stated that it is a great community event. <br /> Acting Mayor LeTourneau stated that it is a joy to see the event grow in the community. <br /> 9.
