Meeting Date: 09/25/2018 By: Chloe McGuire Brigl, Community Development Information Title PUBLIC HEARING: Adopt Ordinance #18-11 Vacating Drainage and Utility Easements Related to the Plat Known as Cottages at the COR (Project No. 17-162); Case of Centra Homes, LLC. Purpose/Background: The purpose of this case is to review a request from Centra Homes, LLC (the "Applicant") to vacate existing drainage and utility easements on PID #28-32-25-14-0094 (the "Subject Property") for the final plat development of Cottages at the COR. The site is generally located southwest of Bunker Lake Boulevard and Ramsey Boulevard. The City Council introduced Ordinance #18-11 vacating drainage and utility easements on September, 11, 2018. Notification: Staff attempted to notify all Property Owners within a 350 foot radius of the Subject Property of the Public Hearing via Standard US Mail. The Public Hearing was also published in the City's official newsletter, the Anoka County Union Herald. Staff also notified small utilities of the request via email and letter. Observations/Alternatives: Alternatives Alternative 1: Adopt Ordinance #18-11 vacating underlying drainage and utility easements for Cottages at the COR. Staff is supportive of this alternative. Alternative 2: Deny Ordinance 18-11 vacating underlying drainage and utility easements for Cottages at the COR. Staff does not support this alternative. Funding Source: All costs associated with this request are the responsibility of the Applicant. Recommendation: Staff recommends adopting Ordinance #18-11 vacating underlying drainage and utility easements for Cottages at the COR on the Subject Property. Action: Motion to waive the Charter requirement to read the ordinance alound and adopt Ordinance #18-11 vacating underlying drainage and utility easements for Cottages at the COR.
