That the Applicant submitted a site plan: requesting to construct a 12,000 square foot office <br />complex on the Subject Property and said site plan will not exceed 50% impervious surface <br />area. <br /> <br />That the Applicant is requesting to eXceed impervious surface restrictions in order to <br />accommodate the building, parking/maneUVering area, and City imposed requirement to <br />construct a 10 foot pedestrian trail along the western boundary line. <br /> <br />That on December 2, 2004, the Planning Commission approved the minor sketch plan and <br />recommended that the City Council apprOVe the proposed Ramsey Office Park site plan, <br />contingent upon obtaining a variance, <br /> <br />10. That the adjacent property to the south is also located within the Scenic River Overlay <br /> District and in 1988 received a Variance ~to allow up to 58% impervious surface area. <br /> <br />11. That the impervious surface restriction is designed to limit and monitor site runoff to the <br /> Rum River. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />1¸9. <br /> <br />That runoff from the Subject Property Will be discharged into a regional stormwater system <br />that pre-treats runoff. The Department of Natural Resources (DNR) stated to City Staff that <br />they are satisfied with the way runoff from the Subject Property will be handled. <br /> <br />That the Subject Property is located approximately 1,000 feet from the Rum River and <br />buffered by an urban lot single family residential development. <br /> <br />That the Applicant has stated the variance requested is the minimum variance needed to <br />alleviate the hardship. <br /> <br />That the special conditions caUSing the Undue hardship and the inclusion of a parcel of land <br />that is in great distance from the Rum RiVer did not result from the actions of the Applicant. <br /> <br />That if denied, the Applicant will not be deprived of developing the Subject Property in a <br />manner that is consistent with City Code and adjacent commercial development. <br /> <br />That if granted, the variance will not permit a use that is prohibited in the B-1 Business <br />District. <br /> <br />That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br /> <br />That if granted, the variance will not endanger the public safety. <br /> <br />That if granted, the variance will not unreasonably diminish property values in the <br />neighborhood. <br /> <br />RESOLUTION #05-01-001 <br /> page,2of 3 <br /> <br /> <br />
