That on December 2 and December 14, 2004, the Planning Commission and City Council <br />approved the preliminary site plan o~ the Ramsey Municipal Center subject to conditions <br />contained in the City Staff :Review :Letter dated November 24, 2004 and the applicant <br />receiving a variance to the maximum setback standards in the TC-1 District. <br /> <br />9. That if granted, the variance will not permit a use that is prohibited in the TC-1 Town Center <br /> Commercial District. <br /> <br />10. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br /> property. <br /> <br />11. That if granted, the variance will not endanger the public safety. <br /> <br />12. That if granted, the variance will not unreasonably diminish property values in the <br /> neighborhood. <br /> <br />13. That if granted, the variance will not violate the intent of the Comprehensive Plan. <br /> <br />14. That, if granted, the variance will not grant the Applicants any special privilege that is denied <br /> to other owners of land in the .same district. <br /> <br />15. <br /> <br />That undue hardship will result if the variance request is denied due to the existence of <br />special conditions and circumstances ~which are peculiar to the land and which are not <br />applicable to other lands in the same district. <br /> <br />16. That the structure is providing a unique :public plaza. <br /> <br />17. That the front of the building will align with the intersecting street. <br /> <br />18. That the Town Center Technical Advisory Committee reviewed and approved the plan. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Chairperson Nixt, <br />and upon vote being taken thereon, the following Voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Brauer <br />Board Member Shepherd <br />Board Member Van Scoy <br />Board Member Watson <br /> <br />and the following voted against: <br /> <br />None <br /> <br />RESOLUTION #05-01-003 <br /> Page 2 of 3 <br /> <br /> <br />
