December 10, 2018 I Volume 12 I Issue 23 Zoning Bulletin <br />The court also rejected Watson's claims that the ordinances authorizing ac- <br />cess roads in the City were unconstitutionally vague as applied to Watson. The <br />court rejected those claims finding that the ordinances did not regulate <br />Watson's conduct in any way. Rather, found the court, the ordinances simply <br />permitted access roads and the creation of a particular access road over a pub- <br />lic right-of-way in the vicinity of Watson's property. <br />In summary, the court concluded that Watson had not been deprived of a <br />property interest nor was he subjected to any vague law within the meaning of <br />the Due Process Clause of the Fourteenth Amendment. <br />See also: State ex rel. With its vote, the <br />committee recommends Bill 108, which will next go before the full County <br />Council. Among other things, Bill 108, "defines where short-term vacation <br />rentals would be allowed, establishes regulations for their use, and provides a <br />way for an owner or operator to obtain a nonconforming use certificate that <br />would allow them to operate in a non -permitted district." <br />Source: Big Island Video News; www.bigislandvideonews.com <br />MARYLAND <br />The Montgomery County Council appears to have tabled a "long-awaited <br />vote on proposed legislation that would allow small cell antennas into residen- <br />tial area." The bill would allow small cell antennas that are 12 to 20 cubic feet <br />in size, attached to an existing utility pole or as part of a new replacement <br />pole. Council asked the city's zoning commission to <br />amend zoning laws to make short-term rental use legal. The zoning commis- <br />sion has now asked the D.C. Office of Planning to study the issue and make <br />recommendations. Meanwhile, the D.C. Council reportedly intends to vote on <br />a short-term rentals bill in November.
