' <br /> <br /> RESoLUTiON 05-02 <br /> <br /> cI ;OF MSE¥ <br /> cOtJ rY, mNN SOTA <br />RESOLUTION ADOPTINGAss~ssMENTs FOR THE ~MSEY TOWN CENTER <br />ADDITION CITY PHASE II ~O~WAY IMPROVEMENT. <br /> <br /> WHEREAS, pursuant to proper notice ]duly given as required by law, the City Council <br />has met and heard and passed uD0n all °bje~tions to the proposed assessment for the City Phase <br />Il Roadway Improvements (the '~mpr°veMOnt"). <br /> <br /> The Improvement is ~h¢r identified in that ce~ain Master Development <br /> Agreement be~een thc CitY :of Ramsey and Ramsey Town Center, LLC dated <br /> September 17, 2003, a ¢0Py of wM~h is on file for public inspection at thc City of <br /> ~amsey Municipal Cent¢~, 1S 153 Nowthcn Boulevard ~, Ramsey, Mi~mesota <br /> during normal business ho~rs. <br /> <br /> NOW, THE~FO~,. B~ IT. ~SOLVED BY THE CITY COUNCIL OF <br />RAMSEY, MINNESOTA: ; : <br /> <br /> 1. Such proposed ass~ssment,;a copy of which is attached hereto and made a pm-t <br />hereof, is hereby accepted and shall ConStitute ]th¢ special assessment against the lands named <br />therein, and each tract of land th~eM included is hereby found to be benefited by the proposed <br />improvement in the amount of the ~sessmcnt levied against it. <br /> <br /> 2. The special assessment will bePayable in a single installment, but the City will <br />defer the obligation to pay the special ~seSsment until the earlier of (i) the date three years after <br />the date of this Resolution or (ii) the date tho City approves a final plat replatting all or a portion <br />of thc assessed lands. Clause (ii) of the Preceding sentence does not apply to final plats the city <br />approved prior to the date of this;Resolution and does not apply to the final plat of ~SEY <br />TOWN CENTER 5TM ADDITION Which has received final plat approval from thc City Council <br />but which is being modified and ~ill be reappr6ved pfor to being recorded. [~terest will accrue <br />on the unpaid balance of the def¢~ed special assessment at the rate of 6.3% per a~um.] <br />assessed lands are replatted, the sPecial assessment wiil be due oMy with respect to the tax parcel <br />or parcels that include all of a p0~i°n o~ thc assessed lands that are being replatted and the <br />special assessment will remain deleted for~the balance of the assessed lands. <br /> <br /> The owner of any proPertY s° ~Sesscd may, at any time prior to ce~ification of <br />thc assessment to the County AUditor, pay~ the Whole of the assessment on such property, with <br />interest accrued to the date of pa~ent, to the City Finance Officer, except that no interest shall <br />be charged if the entire asscssmem is paid'witMn 30 days kom the adoption of this resolution; <br />and owner may, at any time therOa~¢C, Pay, to thc City Finance Officer the entire amount of the <br />assessment remaining unpaid, with interes~ accrued to December ~1 of the year in which such <br />payment is made.
