spaces in the Parking ImproVements allocated to that Parcel in the Parking Plan and the <br />driveways and pedestrian elevators, staiteWays~ sidewalks and walkways that are a part of the <br />Parldng Improvements for the parking of vehicles of a size not to exceed the design parameters <br />of the Parking Improvements and for pedestrian access to and from such vehicles. This easement <br />does not give a Parcel owner aright to use any specific, designated spaces and does not give a <br />Parcel owner any priority over members °fthe Public or other Parcel owners with respect to the <br />use of available spaceS. The number of parking spaces allocated to each Parcel may change as a <br />result of subsequent amendments to ithe Parking Plan, but the City Council may not approve an <br />amendment to the Parking Plan that increases or decreases the number of parking stalls allocated <br />to a Parcel without the consent of the °wn~r of the Parcel. <br /> <br /> 5. Operation of th~ Parking Improvements. The City will operate the Parking <br />hnprovements as public parking facilities': The Parking Improvements will be available to the <br />public on a first come, first served basis subject to the following: <br /> <br /> 5.1. The City will establish handicapped parking stalls within the Parking <br />Improvements as required by law. <br /> <br /> 5.2. The City may :designate, with appropriate signage, parking stalls within <br />the ?arking hnprovements that may only be used for a specified period of time (i.e. "One Hour <br />Parking"). " <br /> <br /> 5.3, The City may designate parking stalls in the Parcel No. 1 Ramp as "park <br />and ride" stalls roi' the exclusive use of public transit patrons during designated days and hours as <br />provided for in the Parking Plan. The City must utilize signage and other parking control <br />n~echanisms in an attempt to limit "park a~d ride" use to the number of parking stalls designated <br />for "park and ride" use in the Parking Plan and must make a good faith effort to enforce <br />restrictions the City adopts to co~ttrol Such use. <br /> <br /> 5.4. The City may elect to charge fees for parking in the Parking <br />hnprovcments; provided the costs associated with the operation of the Parking Improvements on <br />a lee basis will be Parking Maintenange Costs under Section 7 below, and the proceeds received <br />from thc operation of the Parkirlg Improvements on a fee basis will be applied to reduce the <br />budgeted Parking Maintenance Costs allocated among the Parcels pursuant to Section 9 below. <br /> <br /> 5.5. Tl~e City may, from time to time, temporarily limit or deny access to <br />parking spaces within the Parking Improyements as the City determines to be necessary or <br />desirable in connection with the maintenance, rePair or replacement of Parking Improvements or <br />the construction of expansions of°r additions to the Parking Improvements. <br /> 5.6. 24 hour parking will not be permitted in the Parking hnprovements; <br />provided, however, the City may issue permits to owners, tenants or other occupants of <br />residential property within the Parking District t° allow for 24-hour use for such individuals. <br /> <br /> 6. M, ainten,ance~ Repair and ~R.eplacement of the Parking Improvements.
