Associate Planner Wald explained the impervmus surface restriction was established in an <br />attempt to limit and monitor site runoff to the Rum River. She stated that run-off from the site is <br />proposing to be discharged into an existing regional stormwater system that adequately pre-treats <br />runoff to the satisfaction of the Department of Natural Resources (DNR). She noted that the <br />adjacent parcel (the old Amoco site) is also located within the Wild and Scenic River Overlay <br />District and received a variance in 1988 to allow up to 55% impervious surface area. <br /> <br />Ms. Wald indicated that based on DNR's comments and the fact that the property would be under <br />utilized without the issuance of a variance to impervious surface restrictions, Staff recommends <br />approval contingent upon official certification by the DNR. <br /> <br />Public Input <br /> <br />Chairperson Nixt opened the public hearing at 7:11 p.m. <br /> <br />There was no citizen input. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Johnson to close the public hearing at <br />7:11 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Brauer, Johnson, Shepherd, <br />Van Scoy, and Watson. Voting No: None. Absent: None. <br /> <br />Board Input <br /> <br />Board Member Van Scoy asked about the 10-foot path noted in the report. He stated he did not <br />see it shown on the sketch plan. <br /> <br />Associate Planner Wald agreed it was not on the information the Board has, but is on the sketch <br />plan, and there is definitely room for it and plans to construct it. <br /> <br />Motion by Board Member Johnson,i seconded by Board Member Brauer to adopt Resolution #05- <br />01-001 adopting Findings of Fact//0712 favorable to the applicant, relating to a request for a <br />variance from impervious surface restrictions established in the Wild and Scenic River Overlay <br />District. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Shepherd, <br />Van Scoy, and Watson. Voting No.' None. Absent: None. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Brauer to approve the request <br />for a variance from impervious surface restrictions based on the Findings of Fact and adopt <br />Resolution #05-01-002 declaring terms of same. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Shepherd, <br />Van Scoy, and Watson. Voting No: None.
