Councilmember Kuzma introduced the following resolution and moved for its adoption: <br />RESOLUTION #19-060 <br />RESOLUTION AUTHORIZING EXECUTION OF QUIT CLAIM DEEDS AND <br />EASEMENT AGREEMENTS FOR MULTIPLE PARCELS ALONG UTE STREET NW <br />TO CORRECT TITLE ISSUES <br />WHEREAS, a Title Examiner for a prospective buyer of the parcel with PID 401-32-25- <br />11-0012, located on Ute Street north of 179 h Lane, contacted the City of Ramsey regarding a <br />concern with a previous land transaction associated with the reconstruction of Ute Street; and <br />WHEREAS, it appears that the intention of Road Right -of -Way Plat No. 1 was to transfer <br />fee title of Parcels 1-8 to the City of Ramsey for Ute Street and dedicate a permanent drainage and <br />utility easement in favor of the City of Ramsey over Parcels 1P.E.-13P.E.; and <br />WHEREAS, via Quit Claim Deeds, the fee title of Parcels 1P.E.-13P.E. were errantly <br />deeded to the City of Ramsey, thereby removing direct access to Ute Street for the eleven parcels; <br />and <br />WHEREAS, the City of Ramsey desires to correct the title issues by deeding fee title of <br />Parcels 1P.E.-13P.E. back to the respective property owners while simultaneously reserving an <br />easement over these areas for drainage, utility, and in some instances, road right-of-way purposes. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: <br />1) That the Ramsey City Council authorizes execution of the necessary Quit Claim Deeds to <br />reestablish direct access onto Ute Street while simultaneously reserving rights for drainage, <br />utility, and in some instances, road right-of-way purposes. <br />2) That the Ramsey City Council hereby authorizes the Mayor and City Administrator to <br />execute the applicable Easement Agreements to establish responsibilities related to the <br />easements as necessary. <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br />Shryock, and upon vote being taken thereon, the following voted in favor thereof: <br />Acting Mayor Riley <br />Councilmember Kuzma <br />Councilmember Shryock <br />Councilmember Heinrich <br />Councilmember Shryock <br />and the following voted against the same: <br />None <br />
