The sanitary sewer extension Will also requirelan EAW and submittal of a permit application to
the Minnesota Pollution Control Agency (MPCA).

Assistant Public Works Director Olson ~explained the City is the Local Unit of Government
(LGU) responsible for preparing the EAW. A request for proposal was sent to Bolton & Menk,
Inc. for preparation of an EAW for the project and the sewer extension. Bolton & Menk, h~c. has
submitted a proposal to perform the EAW for the project for a fee not to exceed $10,000. The
sewer extension permit and fee will not exceed $3,500. The developer has agreed to go forward
with the EAW and will be reqUired to pay for the studies. Staff recommends the proposal fi'om
Bolton & Menk, h~c. be accepted for Preparation of the EAW for the Pulte Homes Development
at a cost not to exceed $10,000 with a not to exceed fee of $3,500 for the sewer extension EAW
and preparation of the MPCA pen-nit. AUthorization to proceed will not be issued until receipt of
the $13,500 fee fi'om the developer.

Councilmember Cook noted this is part of the area discussed to be a secondary master
dcvelopment plan for surrounding areas to' TOwn: Center. He asked if that will happen before this
development comes forWard at preliminary plat.

Assistant Public Works Director Olson replied the developer has certain rights and has the ability
to go forward with preliminary plat. The developer knows the City is master planning the area
and has said he will wait to see the results if it is completed in a short timeframe. This EAW
would consist of background information the deVelOper would gather. Bolton & Menk has a lot
of background information already. If the 'develOper submits the check staff is willing to proceed
with the study of this particular sketch plan and can expound upon that once the master plmming
is completed.

Councihnember Cook inquired if the possibility of an interchange or a bridge could alter plans in
this area.

Assistant Public Works Director Olson respOnded in the affirmative and explained the plans are
very uncertain at this time.

Councihnember Cook asked if the develoPer is aware of this situation and is still willing to pay
for the EAW.

Assistant Public Works Director Olson replied the EAW would not go forward unless the
developer agrees to this. He explained the official mapping only covers a corhdor, it does not
covet' a footprint of interchanges. The sketch Plan submitted does preserve a 300-foot corridor at
no cost to the City.

Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to authorize preparation
of EAW's and MPCA permit application for Pulte Homes for a fee not to exceed $13,500 by
Bolton & Menk, Inc after receipt °fthe fee ifrom the developer.

City coUnCiFFebruary 22, 2005
Page529 of 31
