Mr. Hudson questioned how the problem could be solved. Commissioner Jensen replied that the City could become tougher on the applicants. If the application is not complete, then it should not be presented to the Commission. Councilmember Hendriksen stated that there were many incidences where City Attorney Goodrich was present at Planning Commission meetings when they were discussing controversial items. Commissioner Dempsy replied that since he has been on the Planning Commission, the City Attorney has never been present in an official capacity. Councilmember Zimmerman suggested that the Chairperson work with the City Administrator on resolving the Commissions legal concems. Mr. Hudson reviewed the suggestions that were addressed during the meeting that included: picking-up the phone, having joint-meetings, clarify goals, use legal counsel, accept the fact that it is not going to be perfect, and if clarification is needed from Council use staff. Commissioner Johnson stated that the Commission has been addressing the Mallard Ponds development and explained that the main objection of residents is due to the traffic concerns, not the density. There remains a significant traffic issue in the area which is outside the Commissions authority and requested that the Council consider the problems the City has with Dysprosium.
