Cory Lepper, Orrin Thompson, said he received the plans from Lord of Life for the grading, yet <br />this was an issue in their letter. He said he was at a loss to respond to their letter. <br /> <br />Chairperson Nixt asked that Staff contact Mr. Hutchison from Lord of Life to work through that <br />issue. <br /> <br />Mr. Lepper stated that a request has been made to remove the median at the entrance and Orrin <br />Thompson would like to keep it. It is an aesthetic addition. <br /> <br />Community Development Assistant Wald indicated the Street Supervisor would like the median <br />removed due to snow plowing. <br /> <br />Mr. Lepper said their engineer has devised a new plan that has worked in other cities. They will <br />have further discussions on this. <br /> <br />Chairperson Nixt noted that there are three 3 ponds proposed adjacent to State Highway #47. He <br />warned that MPCA noise standards may be an issue and they may want to do a study. He asked if <br />there is room for screening in addition to the ponding. <br /> <br />Mr. Lepper indicated that MnDOT and the MPCA said a buffer and berming should bring them <br />into compliance. The study will determine that. This could mean taking out one of the ponds. <br />He noted the storm water plan would need to be redone. <br /> <br />Commissioner Brauer asked if the right of way issue has been worked out with MnDOT. <br /> <br />Mr. Lepper answered they are working with them. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Sweet, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Sweet, Brauer, Reeve, and <br />Watson. Voting No: None. Absent: Commissioners Johnson and Kociscak. <br /> <br />The public hearing closed at 7:51 p.m. <br /> <br />Commission Business <br /> <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:51 <br />p.m. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Sweet, to recommend that the City <br />Council approve the preliminary plat for Birch Hill Lodges contingent upon compliance with City <br />Staff review letter dated November 30, 2001; also contingent upon addressing MnDOT’s request <br />for identifying State Highway 47 right of way; and also contingent upon the resolution of the <br />Cobalt Street extension connecting with the Lord of Life property. <br /> <br /> <br />Planning Commission/December 4, 2001 <br />Page 9 of 18 <br /> <br />
