Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #19-083 RESOLUTION GRANTING APPROVAL OF THE SITE PLAN AND DEVELOPMENT AGREEMENT FOR ACE SOLID WASTE INC.'S TRANSFER STATION EXPANSION RECITALS 1. Ace Solid Waste, Inc., hereafter referred to as "Developer", properly applied for Site Plan approval of the following described property located in the City of Ramsey: Lot 1 and 1A, Block 1, Ace Addition, Anoka County, Minnesota (the `Subject Property' ); WHEREAS, the City of Ramsey received applications for a Variance, Amended Conditional Use Permit, and Site Plan for a proposed expansion of a mixed solid waste and recyclable materials transfer station from the Developer on May 8, 2019; and WHEREAS, the Ramsey Planning Commission reviewed and approved the requested Variance and reviewed and recommended approval of the requested Amended Conditional Use Permit and Site Plan on April 4, 2019; and WHEREAS, the City Council reviewed the request for an Amended Conditional Use Permit and Site Plan on May 14, 2019. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council hereby grants approval of the Site Plan and Amended Conditional Use Permit, as well as the Development Agreement, for the expansion of the mixed solid waste and recyclable materials transfer station in accordance with relevant City Codes, subject to the following conditions: a) Compliance with the Staff Review Letter dated May 1, 2019 b) Approval by the City Engineer. c) The Developer entering into a Development Agreement with the City. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent:
