Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #19-178 <br />RESOLUTION AUTHORIZING THE CITY OF RAMSEY TO AMEND RIGHT OF <br />RE-ENTRY AGREEMENT <br />WHEREAS, the City of Ramsey, herein referred to as the "City," has entered into a Right <br />of Re -Entry Agreement ( the "Agreement") with Centra North, LLC (the "Developer") on <br />November 28, 2018; and <br />WHEREAS, the Developer has communicated to the City that it is unable to complete the <br />project under all the terms and conditions of the Agreement due to inclement weather, and other <br />factors and has requested it be amended to extend the deadline of the issuance of the first five <br />Certificates of Occupancy from October 1, 2019 to December 31, 2019; and <br />WHEREAS, the City has drafted an Amended Right of Re -Entry Agreement incorporating <br />the requested deadline extension and the Ramsey EDA has reviewed and recommended approval. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the City authorizes the City Administrator and Mayor to sign the Amended Right -of - <br />Re -Entry Agreement; subject to City Attorney approval. <br />That the motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />and upon vote being taken thereon, the following voted in favor: <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />Existing Vacancy <br />Existing Vacancy <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />23rd day of July, 2019. <br />Mayor <br />
