Councilmember Kuzma introduced the following resolution and moved for its adoption: <br />RESOLUTION #19-171 <br />RESOLUTION GRANTING APPROVAL OF AN AMENDMENT TO THE DEVELOPMENT <br />AGREEMENT FOR ACE SOLID WASTE INC.'S TRANSFER STATION EXPANSION <br />RECITALS <br />1. Ace Solid Waste, Inc., hereafter referred to as "Developer", properly applied for Site Plan <br />approval of the following described property located in the City of Ramsey: <br />Lot 1 and IA, Block 1, Ace Addition, Anoka County, Minnesota <br />(the `Subject Property'); <br />2. The City of Ramsey received applications for a Variance, Amended Conditional Use Permit, and <br />Site Plan for a proposed expansion of a mixed solid waste and recyclable materials transfer <br />station from the Developer on March 11, 2019; and <br />3. The Ramsey Planning Commission reviewed and approved the requested Variance and reviewed <br />and recommended approval of the requested Amended Conditional Use Permit and Site Plan on <br />April 4, 2019; and <br />4. The City Council reviewed the request for an Amended Conditional Use Permit and Site Plan on <br />May 14, 2019; and <br />5. On May 14, 2019 the Ramsey City Council approved an Amended Conditional Use Permit, Site <br />Plan, and Development Agreement for the proposed expansion; and <br />6. The Lower Rum River Watershed Management Organization (LRRWMO) has storm water <br />infiltration requirements for new developments; and <br />7. The Minnesota Pollution Control Agency (MPCA) has determined that due to the type of use <br />(Transfer Station), infiltration is not permissible on the Subject Property; and <br />8. In lieu of constructing an infiltration basin on the Subject Property, the Developer has provided <br />an estimated cost for the infiltration basin and shall contribute that amount to the City's regional <br />system for infiltration; and <br />9. The Development Agreement has been amended to address the infiltration payment in lieu of <br />actual construction. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants approval of the amended Development Agreement. <br />
