Board Member Johnson introduced the foll'o~ting:resolution and moved for its adoption: <br /> i RESOLUTION #05-02-033 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0715 RELATING TO DARRELL <br />ANDERSON'S REQUEST FOR A VARIANCE TO LOT WIDTH AND LOT AREA IN <br />THE CRITICAL RIVER oVERLAY DJ[STRICT <br /> <br /> WHEREAS, Darrell Anderson, hereinafter referred to as "Applicant", properly applied <br />for a Board of Adjustment variarice from Section 9.21.07 of the Ramsey City Code to render the <br />following legally described propOrties as b¢ildable lots with a variance to lot width and lot area: <br /> <br /> Lot 1 Block 1 Bowers MississipPi; Acres 2na Addition together with Lot 33 Bowers <br /> Mississippi Acres, Anoka CoUnty, Minnes. ota <br /> <br /> (the "Subject Property") <br /> <br /> rqow, TUEREVOR SE SOt,WD BY T IE BOAm) ADJUSTMENT <br />OF THE CITY OF RAMSEY~ ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br /> Section 9.03.07 of the Ramsi~y City Ci~de On February 3, 2005, and that said public hearing <br /> was properly advertised and :that the n~inutes of said public hearing are hereby incorporated <br /> as a part of these findings bY reference.7 <br /> <br />2. That the Subject Property is zoned R-1 Residential. <br /> <br />That the surrounding parcels are also zoned R-1 Residential. <br /> <br />That the Subject Property is located in the Critical River Overlay District. <br /> <br />That Section 9.21.07, Subd. 1.a of the Ramsey City Code requires a minimum of 200 feet of <br />lot width and 2.5 acre lot size.: <br /> <br />That Section 9.21.07, Subd. 2;c. 1 (Critical River Overlay District/Existing Lots of Record) of <br />the Ramsey City COde indicates that only "lots of record in the office of the County Register <br />of Deeds (or Registrar of Titles) prior ,t9 July 29, 1985 (date of enactment) which do not meet <br />the requirements of 9.21.07, Shbd; 1, niay be allowed as building sites provided: <br /> <br />a) such use is permitted in the zoning district <br />b) the lot is in separate ownership.from :abutting lands, and <br />c) all other sanitary and dimensional requirements of 9.21 Environmental <br /> Protection are complied with insofar :as practical." <br /> <br /> <br />
