Councilmember Pearson introduced the following resolution and moved for its adoption: RESOLUTION/405-02-037 A RESOLUTION RESCINI)ING Fll~.~ DINGS OF FACT AND A CONDITIONAL USE PERMIT TO CONSTRUCT :A BUILDING LARGER THAN 35,000 SQUARE FEET IN THE TC-2 zoNING DISTRICT WHEREAS, in June 2004, Ramdance LLC, applied for a Conditional Use Permit to construct a building larger than 35,000 square feet in the TC-2 Zoning District on property, legally described as follows: Outlot I, Ramsey Town Center AdditiOn, Anoka County, Minnesota ("Subject Property"); and WHEREAS, that on July 27, 2004, the Ramsey City Council issued a CLIP to the Applicant for the development of up to a 63i000 square foot grocery store on the Subject Property. And WHEREAS, That the AppliCant has requested an amendment to the CUP issued on July 27, 2004 to allow for future expansions of the grocery building up to a maximum of 70,000 square feet. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, i STATEiOF MINNESOTA as follows: 1. That the Applicant has submitted a new site plan to construct a 62,000 square foot grocery store and the building size (footprint) is established at 70,000 square feet. That Resolutions #04-07-197 and #04-07-198 adopting findings of fact and approving a conditional use permit for a 54,000 square foot grocery store and the building size (footprint) at 63,000 square feet are rescinded. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Cook, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Pearson Councilmember Cook Councilmember Elvig Councilmember Jeffrey Councilmember Olson Councilmember Strommen and the following voted against the same: None
