CC Regular Session <br />Meeting Date: 08/12/2019 <br />Submitted For: Tim Gladhill, Community Development <br />By: Eric Maass, Community Development <br />4. 12. <br />Information <br />Title <br />Adopt Resolution #19-193 Approving Updated Development Agreement for Anderson Dahlen (Project #19-109); <br />Case of Knoll Properties (Anderson Dahlen) <br />Purpose/Background: <br />The purpose of this case is to review an updated development agreement between the City of Ramsey and <br />Anderson Dahlen. City Staff has been actively working with Anderson Dahlen on language within the City's <br />standard development agreement and has provided the updated development agreement for consideration by the <br />City Council. <br />The City recently approved a proposed Plat and Site Plan for a new manufacturing facility at the southeast corner <br />of Jaspar Street and 143rd Ave (the "Subject Property"). The Subject Property is owned by the City and the <br />Applicant has an active purchase agreement with the City. The Subject Property would be about nine (9) acres in <br />size. The remainder of the property would be retained by the City for a future Public Works Campus. <br />Notification: <br />Notification is not required and was not completed for this City Council Review <br />Observations/Alternatives: <br />The development agreement is being put in place to cover private site improvements and does not include any <br />public improvements. The development agreement has been updated to reflect that information with additional <br />language added related to timing of rights of re-entry and timing of construction. <br />Alternative 1: Adopt Resolution # 19-193 Approving Updated Development Agreement for Anderson Dahlen. The <br />development agreement is subject to review and approval by the City Attorney. Staff does not anticipate issues <br />with the proposed revisions from the city's standard development agreement. Staff is supportive of this alternative. <br />Alternative 2: Adopt Resolution # 19-193 Approving Updated Development Agreement for Anderson Dahlen with <br />revisions as proposed by City Council. Staff is not opposed to this option however we believe to have ironed out <br />the necessary details with the Applicant with review by legal staff. <br />Alternative 3: Do not adopt Resolution #19-193 approving an updated development agreement for Anderson <br />Dahlen. Execution of a development agreement is the next step in the development process. <br />Funding Source: <br />All costs associated with this request are the Applicant's responsibility. <br />Recommendation: <br />Staff recommends adoption of Resolution #19-193 Approving the updated Development Agreement for Anderson <br />Dahlen; contingent upon compliance with approval of final construction plans by the City Engineer and review of <br />the development agreement by the City Attorney. <br />Action: <br />
