Our Mistioi}: To work together to reipoiibly grew our comma nityr, and to provide quality, cent-oliBcdwe, and efficient government services. <br />CC Regular Session 4. 14. <br />Meeting Date: 08/12/2019 <br />By: Tim Gladhill, Community Development <br />Information <br />Title: <br />Adopt Resolution #19-196 Approving Multiple Agreements Related to the Delta ModTech Project <br />• Right of Entry Agreement <br />• Stormwater Treatment and Ponding Maintenance Agreement <br />• Trail Easement <br />Purpose/Background: <br />The purpose of this case is to approve several miscellaneous agreements related to the Delta ModTech <br />development project. As referenced at the July 23, 2019 City Council Meeting, there were a few more minor <br />agreements pending as referenced in this case title. <br />As the Council recalls, approvals have been given for this 220,000 square foot industrial building located near the <br />northeast intersection of Bunker Lake Boulevard and Puma Street. The project is expected to relocate <br />approximately 120 jobs from an adjacent community to Ramsey and create 15 new jobs for the area. A Tax <br />Increment Financing (TIF) Assistance Package has also been granted to the project. <br />Notification: <br />Notification is not required for this step. Notification was provided for several previous steps in this process. <br />Observations/Alternatives: <br />Right of Entry Agreement <br />The Right of Entry Agreement provides the City access to hydrants installed on private property to complete <br />routine maintenance and flushing. The watermains onsite will remain private. This is a standard agreement utilized <br />in this circumstance. <br />Stormwater Treatment and Ponding Maintenance Agreement <br />The onsite stormwater ponds will be private and maintained by the Owner. Since the ponds will not be maintained <br />by the City, the City needs to ensure that ponds continue to function as designed. This agreement holds the Owner <br />accountable for necessary stormwater pond maintenance. <br />Trail Easement <br />As part of the approval process, the Owner has agreed to convey the necessary trail easement needed for the future <br />Lake Itasca Greenway. This is the legal instrument to convey said easement. The exact legal description is still <br />being developed, and will be inserted into the final version. <br />Funding Source: <br />
