• Definitions of Family <br />As noted in the RAI Addendum, restrictive definitions of family can impede unrelated <br />individuals from sharing a dwelling unit.24 The Addendum surveys entitlement jurisdiction <br />zoning codes for indications that definitions of "family" have the effect of preventing <br />unrelated individuals from sharing the same residence.25 <br />• Group Homes <br />HUD and the Department of Justice have issued a Joint Statement on "Group Homes, Local <br />Land Use, and the Fair Housing Act," (updated August 6, 2015). The Statement provides <br />that the following actions with respect to group homes would violate the Fair Housing Act: <br />• Land use policies that treat groups of <br />persons with disabilities less favorably <br />than groups of non -disabled persons; <br />• Taking action against or denying a <br />permit to a home because of the <br />disability of the individuals who would <br />live there; or <br />• Refusing to make a reasonable <br />accommodation in land use and zoning <br />policies and procedures where such accommodations are necessary to afford <br />persons with disabilities an equal opportunity to enjoy housing.26 <br />24 Addendum to the RAI, pg. 93. <br />25 State law provides that persons with disabilities should not be excluded by zoning ordinances, and sets rules on <br />what restrictions cities can place on group homes of 6 residents or less as well as larger group homes.
