A
final draft should be ready by the next Counci! meeting. There is an attempt to include an
amendment to the Master Development Agreeme~nt in this allocation agreement that would be an
announcement of an agreement between the secondary developer, the master developer, and the
City. The City does not want secondarY-develgpers to have the ability to amend the Master
Development Agreement. He eXPlained what is !difficult at this time is they are in limbo. The
Master' Development Agreement amendment-is not completed, and this must be paralleled with
the potential that it will be approved. That;makes this agreement confusing and difficult to draft.
Attorney Tom Bray has indicated the amendmen~ will not be completed by the Council meeting
on Tuesday. Staff will be trying t° encouragehim to have the amendment completed.

City Administrator Norman indicated D. R. Horton will likely allow RTC to buy them out and
have other developers come in. He thinks this is;good news for the project.

City CoUnCil/November 16, 2004
Page 2[ of 3
