CC Regular Session <br />Meeting Date: 09/24/2019 <br />Submitted For: Tim Gladhill, Community Development <br />By: Elliot Mohler, Community Development <br />Information <br />4. 10. <br />Title <br />Adopt Resolution #19-228 Approving Code Enforcement Action Plan at 17030 Baugh St NW <br />Purpose/Background: <br />The purpose of this case is to review the code enforcement activities at 17030 Baugh St NW (the "Subject <br />Property") for an extension of code enforcement actions and time for cleanup. Staff has been working with various <br />code enforcement actions on this property for outdoor storage, off-street parking, and the operation of a garbage <br />hauling business (the "Home Occupation") without proper permitting. City Staff has previously sent one notice of <br />violation, conducted one site visit, had multiple calls with the Property Owners, and met in person with the Property <br />Owners in person regarding code enforcement issues. Due to the number of items on the property and severity of <br />the issue, Staff believes an extension for clean up and code compliance is necessary. In addition, the Property <br />Owners have been made aware of the resolution and has agreed to its provisions. <br />Please note that if the Owner applies for a formal Home Occupation Permit, the Owner is entitled to due process <br />for the City to consider this request. In other words, that process might push compliance beyond the timeframe <br />outlined in this resolution. <br />Notification: <br />No notification required. <br />Observations/Alternatives: <br />Alternative 1: Adopt Resolution #19-228 Approving Code Enforcement Action Plan at 17030 Baugh St NW. The <br />Property Owners have been cooperative with Staff and when provided the draft dates of compliance was agreeable <br />to them. Staff is supportive of this alternative. <br />Alternative 2: Do not adopt Resolution #19-228 Approving Code Enforcement Action Plan for 17030 Baugh St <br />NW. City Council should provide specific direction to staff as to how to proceed with this active code enforcement <br />case. Staff is not opposed to this alternative but believes that the approach and timeline outlined in the proposed <br />resolution is appropriate. <br />Funding Source: <br />Staff handles code enforcement as part of their normal duties. <br />Recommendation: <br />Staff recommends approval of Resolution #19-228, which will extend the time for cleanup at 17030 Baugh St NW. <br />Action: <br />Motion to adopt Resolution #19-228 approving an extension of cleanup and code enforcement actions at 17030 <br />Baugh St NW. <br />Attachments <br />
