CC Regular Session <br />Meeting Date: 09/24/2019 <br />Submitted For: Tim Gladhill, Community Development <br />By: Eric Maass, Community Development <br />4. 14. <br />Information <br />Title <br />Adopt Resolution #19-240 Approving Development Agreement for Suite Living (Project #19-121); Case of <br />Hampton Companies <br />Purpose/Background: <br />The purpose of this case is to consider the proposed development agreement between the City and Hampton <br />Companies, Inc for the purposes of a 23 unit senior living facility. The City previously approved the site plan for <br />the project (Resolution #19-154) on July 23, 2019. A condition of approval for the site plan was entering into a <br />future development agreement with the City. <br />Notification: <br />No additional notification is required for the consideration of the proposed development agreement. The <br />development project itself has been reviewed by both the Planning Commission and City Council with appropriate <br />public notice issued with that review. <br />Observations/Alternatives: <br />The proposed development agreement is the City's standard form and the development agreement itself is the next <br />step in the development process towards actual construction of the project. City Council should note that <br />development fees for the property have been previously paid by Paxmar LLC via their development agreement <br />(Resolution #19-151) with the City when they previously platted the lot. The fees paid were based on the proposed <br />Suite Living project. The proposed development agreement recognizes that those fees were previously collected. <br />The City will still require the standard financial surety, inspection fee, warranty, and landscaping maintenance <br />warranty based on the reviewed engineers estimate. <br />Alternatives <br />Alternative 1: Adopt Resolution #19-240 approving the development agreement for Suite Living. The proposed <br />development agreement is the City's standard form and the Applicant has not opposed of any language. Staff <br />supports Alternative 1. <br />Alternative 2: Do not adopt Resolution #19-240 approving the development agreement for Suite Living. The <br />development agreement is the next step in the development process and necessary prior to the project beginning <br />construction. Staff does not support this alternative. <br />Funding Source: <br />Costs associated with this request are the responsibility of the Applicant. <br />Recommendation: <br />Staff recommends adoption of Resolution #19-240 approving a development agreement for Suite Living (Project <br />#19-12); Case of Hampton Companies. <br />Action: <br />
