CC Regular Session <br />Meeting Date: 09/24/2019 <br />Submitted For: Tim Gladhill, Community Development <br />By: Eric Maass, Community Development <br />Information <br />4. 15. <br />Title <br />Adopt Resolution # 19-241 Approving a Drainage and Utility Easement Encroachment Agreement between the City <br />of Ramsey and Ramsey Station Apartments, LLC (AEON) <br />Purpose/Background: <br />The purpose of this case is to consider an encroachment agreement for an encroachment into a city drainage and <br />utility for the purposes of a trash enclosure that was constructed 2'7" into the City's drainage and utility easement. <br />The easement was provided to the City by Aeon as part of their plat of Greenway Terrace. As the developer and <br />contractor were surveying the constructed sites to provide as -built drawings it was discovered that the trash <br />enclosure was constructed 2'7" into the City's easement. <br />Notification: <br />No notification is required for the requested action. <br />Observations/Alternatives: <br />Alternatives <br />Alternative 1: Adopt Resolution #19-241 approving a drainage and utility easement encroachment agreement <br />between the City and Ramsey Stations Apartments for the purposes of a trash enclosure that was constructed 2 feet <br />7 inches into the City's drainage and utility easement. The encroachment does not extend over any utility lines and <br />the City Engineer has indicated support for the requested encroachment. Staff supports this alternative. <br />Alternative 2: Do not adopt Resolution # 19-241 approving a drainage and utility easement encroachment <br />agreement. The City could require that the trash enclosure be removed and reconstructed so that it is outside of the <br />drainage and utility easement; however, City Staff does not think that is necessary as the encroachment does not <br />directly impact any utilities. Staff does not support this alternative. <br />Funding Source: <br />Staff is handling this request as part of its normal duties. <br />Recommendation: <br />Staff recommends adoption of Resolution # 19-241 Approving a Drainage and Utility Easement Encroachment <br />Agreement between the City of Ramsey and Ramsey Station Apartments, LLC. The trash enclosure which extends <br />into the drainage and utility easement has not been constructed over any utilities and the City Engineer is <br />supportive of the requested encroachment. <br />Action: <br />Motion to adopt Resolution # 19-241 Approving a Drainage and Utility Easement Encroachment Agreement <br />between the City of Ramsey and Ramsey Station Apartments, LLC. <br />Attachments <br />
